Why Couples Choose Phone Mediation Services

Phone (distance) mediation is far less confrontational.  The parties involved never have to see each other if they so choose.  The divorce mediation process is non-adversarial; both people together are helped to work out a settlement of terms which will be comfortable and fair for each. Through mediation, the mediator(s) assist both parties to address and explore the needs, concerns and options for each person in relevant areas. These could be: property division, child custody and parenting, child support, alimony (or maintenance), insurance and taxes.

All aspects of the mediation process are confidential. The mediators may not be asked to testify for or against either party in any court hearing, nor may the documents, notes, and information taken during the process.

During an introductory meeting the mediation process will be discussed and an agenda designed which will meet the specific needs of each person. At the end of the introductory meeting, both people can decide whether or not they wish to pursue mediation together.

Usually, the couple agree to share the fee and payment is expected following each meeting. The fee is negotiable only if individuals are experiencing extreme, long-term financial difficulties.

The average expectable divorce mediation process includes, generally, there to four mediation sessions, each lasting approximately 1 hour.

At any time during the divorce mediation process, either or both parties can consult attorneys or other professionals and are encouraged to do so.

The agreement reached will be a Memorandum Of Understanding. In our view, it is a reflection of matters discussed in each successive meeting and as such is subject to any additional changes or alternatives to better express the interests of each party. As a draft it is a working document until a final Memorandum is reached, at the conclusion of the mediation, prior to the signing of the document, each is asked to review it with an attorney or financial advisor.
